India's Draft Digital Competition Bill: A Catalyst or Constraint for Startup Growth?

The government's Digital Competition Bill, unveiled on September 18, introduces tailored compliance requirements for large platforms to prevent anticompetitive practices and unlock growth opportunities for smaller technology ventures. It mandates phased thresholds for "significant market players," obliging them to provide data portability, non-discriminatory access to APIs, and transparent ranking algorithms.

Startups applaud proactive measures to level the playing field but caution that excessive reporting burdens may divert resources from core product development. Industry associations recommend a balanced approach: streamlined thresholds, clear timelines, and sunset clauses to encourage ongoing innovation.

Union Minister Ashwini Vaishnaw emphasized that India's digital economy must guard against "winner-takes-all" dynamics while fostering homegrown champions. As the Bill moves to Cabinet review, stakeholders are lobbying for clarity on penalties and appeal processes.
